Finch & Kelly is a bespoke men’s clothier located at 1003 Van Buren Ave, Oxford, Mississippi 38655. We offer custom-made and ready-to-wear men’s clothing, accessories, and apparel through our physical store and this website.

4.1 Product Descriptions
We make every effort to display products and their colors, fabrics, and details as accurately as possible. However, we cannot guarantee that your screen’s display of any color or texture will be completely accurate. Product descriptions are provided in good faith and are subject to change without notice.
4.2 Pricing
All prices listed on the Site are in U.S. dollars and are subject to change without notice. We reserve the right to modify or discontinue any product or service without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of a product or service.
4.3 Errors and Inaccuracies
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. This includes the right to cancel orders placed based on incorrect pricing or product information.
5. Orders and Payment
5.1 Order Acceptance
Placing an order through this Site constitutes an offer to purchase. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in product or pricing information, or concerns identified by our fraud detection systems.
Your order is not confirmed until you receive an order confirmation email from us.

By submitting your payment information, you represent that you are authorized to use the payment method provided and authorize us to charge your payment method for the total amount of your order, including any applicable taxes and shipping fees.
5.3 Sales Tax
Applicable sales tax will be collected on orders shipped to Mississippi in accordance with Mississippi state law. Tax rates are determined based on the shipping destination.
6. Custom and Bespoke Orders
6.1 Nature of Custom Orders
Bespoke and custom-made garments are produced specifically for each individual customer based on measurements, fabric selections, and specifications provided at the time of order. Because custom garments are made to your individual specifications, they are non-refundable and non-returnable except as described in Section 6.3 below.
6.2 Deposits and Payment Schedule
Custom orders require a deposit at the time the order is placed. The deposit amount and payment schedule will be communicated to you at the time of your appointment or order. By paying a deposit, you agree to the full purchase price of the custom garment.
6.3 Custom Order Alterations and Defects
If your custom garment contains a manufacturing defect or does not conform to the agreed-upon specifications, we will work with you to remedy the issue through alterations or, at our sole discretion, remake the garment. We are not responsible for changes in your measurements between the time of your fitting and the delivery of your garment.
6.4 Production Timeline
Custom and bespoke garments typically require 4 to 6 weeks for production following your fitting appointment and fabric selection. Production timelines are estimates and may vary due to fabric availability, production schedules, or other factors outside our control. We are not liable for delays in production or delivery.
7. Shipping and Delivery
7.1 Shipping Methods and Timeframes
We ship to addresses within the United States. Shipping options, carriers, and estimated delivery timeframes will be presented at checkout. Estimated delivery dates are not guaranteed and are subject to carrier availability and conditions.
7.2 Shipping Costs
Shipping costs are calculated at checkout based on the order total, weight, and destination. We reserve the right to change shipping rates at any time.
7.3 Risk of Loss
Risk of loss and title to products pass to you upon delivery of the products to the carrier. We are not responsible for delays, damages, or losses caused by the carrier after the package has been delivered to the carrier.
7.4 Undeliverable Packages
If a package is returned to us as undeliverable due to an incorrect address provided by you, you will be responsible for any additional shipping charges required to redeliver the package.

8.1 Ready-to-Wear and Accessory Items
Ready-to-wear apparel and accessories may be returned within 14 days of the delivery date, provided the items are:
- Unworn, unwashed, and unaltered
- In their original condition with all original tags attached
- Free from odors, stains, or damage
Items that do not meet these conditions will not be accepted for return.
8.2 How to Initiate a Return
To initiate a return, contact us at the information provided in Section 1 before shipping any items back. Items returned without prior authorization may not be accepted.
8.3 Refund Processing
Approved refunds will be processed to the original payment method within 7 to 10 business days of our receipt and inspection of the returned item. Shipping costs are non-refundable.
8.4 Exchanges
We are happy to accommodate exchanges for a different size or color where inventory allows. Contact us to confirm availability before returning your item.
8.5 Final Sale Items
Items marked as Final Sale are not eligible for return or exchange.
8.6 Custom and Bespoke Orders
As noted in Section 6, custom and bespoke orders are non-refundable except in cases of manufacturing defect or non-conformance with agreed specifications.
9. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, product photographs, and design elements, is the property of Finch & Kelly or its content suppliers and is protected by applicable United States and international intellectual property laws.
You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content without express written permission from Finch & Kelly.
9.1 Third-Party Brands
Some products available on this Site are produced by or in partnership with third-party brands. All third-party trademarks, brand names, and logos displayed on this Site are the property of their respective owners. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FINCH & KELLY, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS AND CONDITIONS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Any legal action or proceeding arising under these Terms and Conditions shall be brought exclusively in the state or federal courts located in Lafayette County, Mississippi, and you hereby consent to the personal jurisdiction and venue of such courts.
